The Rice Case

The Rice case involved a construction accident that occurred when a worker fell from a ladder while installing pipes at an elevated height. As a result of his fall, he sustained serious and permanent injuries, which eventually led to his death nearly two years later from the effects of Fentanyl and other medications prescribed by his treating doctor for his injuries. Despite the defendants’ arguments that the plaintiff’s careless conduct caused the accident, we were able to establish the defendants’ liability under Labor Law §240(1), due to their failure to provide adequate safety devices. Critically, we were able to demonstrate that the worker’s death, resulting from his medication, was causally related to the accident, notwithstanding the passage of time.

The DeLuca Case

The DeLuca case involved an off-duty New York City Police Officer, who was killed in a motorcycle accident. Prior to his death, the victim had been living with and supporting his younger sister. However, since the decedent did not have a Will, under the law existing at the time of his death, his sister was not entitled to receive any compensation from the wrongful death lawsuit, since he was also survived by his mother. Subsequent to his death, his mother renounced her rights to the proceeds of the wrongful death lawsuit. Based upon this, we argued that the sister was entitled to become the next in line and receive the proceeds from the wrongful death lawsuit. The DeLuca case established new law in the area of wrongful death to the benefit of the families of victims who have been tragically killed in accidents. In certain wrongful death cases, these families now have access to a significantly larger financial recovery.
