A 60-year-old woman was struck and killed by a sanitation truck in Greenwich Village, New York, this week. According to the New York Post, the woman was crossing Sixth Avenue at its intersection with West 8th Street at the time. She was dragged under the truck and crushed by its tires.

According to a witness to the brutal accident, “she basically got pulled underneath and it crushed her skull, you could hear everything break . . . . I couldn’t believe what I was witnessing.” “There’s no words to describe when you literally watch someone die,” the witness added.

The vehicle involved was a 10-wheel Mac truck that belonged to M&M Sanitation, which operates out of Newark, New Jersey. Unfortunately, due to the size and weight of these vehicles, accidents involving garbage trucks often result in catastrophic injury or wrongful death of an innocent victim.

According to the New York Daily News, trucks account for just 3.6% of the vehicles on City streets but yet are involved in 32% of cyclist fatalities and 12.3% of pedestrian deaths in collisions.

The attorneys at The Grandelli Firm have a tremendous amount of experience in handling cases involving serious injury due to the negligent operation of a truck. In these cases, we retain the necessary experts to establish liability and damages including accident reconstructionists. When necessary, we will hire an expert to conduct an inspection of the truck to analyze the mirrors, windows and other appurtenances of the vehicle to show that the driver negligently failed to utilize proper care in the operation of the vehicle.

Further, since many trucks have “blind spots”, they may be required to be equipped with a warning device which beeps or alerts pedestrians and drivers of other cars when the truck is being operated in reverse. As in any case where our client has been seriously injured, we invest the time and money to ensure that the victims of truck accidents obtain the justice they are entitled to under our civil justice system.

Finding an attorney to represent you as soon as possible is particularly important in cases involving city vehicles like those operated through the Sanitation Department of the City of New York. In any claim against a municipality, like the City of New York, a person has only a limited time to file what is known as a “Notice of Claim” against the municipality in order to preserve a viable claim. If you do not file a Notice of Claim within the legally specified time frame, you will likely be barred from suing completely.

If you or a loved one has been injured in a truck accident, call our office. Our attorneys and staff will give your case the individual attention it deserves.
